Regulations of the online shop „Decoria Studio”

(„Regulations”)

§1 
Introductory provisions

The online shop with interior design elements “Decoria Studio” available at https://decoriastudio.com/en/shop/ (next “Shop“) is leaded by Patrycja Tachmańska, who leads a business called Decoria Studio Patrycja Tachmańska, ul. Stanisława Dubois 12 lok. 30B, 00-188 Warszawa, NIP: 8241754874 (next “Decoria Studio“).

These Regulations are addressed to both Consumers and Entrepreneurs using the Shop and define the rules of using the Shop and the rules and procedure for concluding contracts with the Customer at a distance through the Shop.

§2 
Definitions
  1. Consumer – a natural person concluding a Sales Agreement with Decoria Studio as part of the Shop, the subject is not directly related to its business or professional activity.
  2. Decoria Studio – Seller, ie Patrycja Tachmańska leaded a business called Decoria Studio Patrycja Tachmańska, ul. Stanisława Dubois 12 loc. 30B, 00-188 Warszawa, NIP: 8241754874, leaded the Shop.
  3. Customer – each entity making shopping through the Shop.
  4. Entrepreneur – a natural person, a legal person and an organizational unit that is not a legal person, that the separate law admits legal capacity, using a business activity on her behalf, that uses the Shop.
  5. Shop – an online shop leaded by Decoria Studio at the Internet address https://decoriastudio.com/en/shop/ depending on the sale of Products with elements of interior design.
  6. Distance contract – Sales agreement concluded with the Customer as part of an organized system of concluding distance contracts (as part of the Shop), without the simultaneous physical presence of the parties, with only use of the one or more means of distance communication until the conclusion of the Agreement, inclusive.
  7. Regulations – these Shop regulations.
  8. Order – the Customer’s statement folded with the Order Form and headed directly to the conclusion of the Product Sales Agreement or Products with Decoria Studio.
  9. Account – Customer’s account in the Shop, it contains data provided by the Customer and information about Orders placed by him in the Shop.
  10. Registration form – a form available in the Shop, enabling the creation of an Account.
  11. Order form – an interactive form available in the Shop that allows placing an Order, in particular by adding Products to the Cart and specification of conditions of the Sales Agreement, including the method of delivery and payment.
  12. Cart – an element of the Shop’s software in which the Products selected by the Customer are visible, and it is also possible to determine and modify the Order data, in particular the quantity of Products.
  13. Product – a movable item available in the Shop (interior design elements) which is the subject of the Sales Agreement between the Customer and Decoria Studio. Currently, the Shop’s assortment includes ceramic tiles, which are available only on request.
  14. Sales Agreement – a contract for the sale of the Product (s) concluded between the Customer and Decoria Studio through the Shop.

  7. The customer may communicate with Decoria Studio using the addresses and telephone numbers provided in this paragraph.
  8. The client may communicate by phone with Decoria Studio on working days between 9:00 am and 5:00 pm, Monday to Friday.
§4 
Technical requirements

To use the Shop, including viewing the Shop’s assortment and placing Orders for Products, are necessary:

  1. terminal device with access to the Internet and a web browser;
  2. an active e-mail account (e-mail);
  3. cookies enabled.
§5
General information

To create an Account in the Shop, complete the Registration Form. It is necessary to provide the following data:

  1. name and surname or company name;
  2. address for delivery;
  3. telephone number;
  4. e-mail address;
  5. NIP (in the case of Entrepreneurs).

Creating an Account in the Shop is free.

Logging in to the Account is done by entering the login and password set in the Registration Form.

The Customer has possibility at any time, without giving a reason and without incurring any fees, remove the Account by sending an appropriate request to Decoria Studio, in particular through e-mail or in writing to the addresses provided in § 3.

Creating an Account in the Shop

To create an Account in the Shop, complete the Registration Form. It is necessary to provide the following data:

  1. name and surname or company name;
  2. address for delivery;
  3. telephone number;
  4. e-mail address;
  5. NIP (in the case of Entrepreneurs).

Creating an Account in the Shop is free.

Logging in to the Account is done by entering the login and password set in the Registration Form.

The Customer has possibility at any time, without giving a reason and without incurring any fees, remove the Account by sending an appropriate request to Decoria Studio, in particular through e-mail or in writing to the addresses provided in § 3.

Rules for placing the Order

In order to place the Order you must:

  1. log in to the Account in the Shop (after registering) or go to point b) and place an Order without registration;
  2. select the Product that is the subject of the Order, the number of pieces, and then click the “Add to basket” button, in case of plate tiles (one piece), click the “Order plate tiles” button;
  3. if you have chosen to place an Order without registration or have not previously created an Account – after clicking the “Proceed to checkout” button, complete the Order Form by entering: customer data, customer’s address, choose the method of delivery of the Product – courier or personal pick-up, enter the shipping address, if it is different from the customer’s address;
  4. choose one of the available payment methods, if it is a payment by bank transfer, the payment should be made within 1-3 days, if there is an electronic payment through the Przelewy24 or Blik platform, the payment should be made immediately;
  5. click the “Place order” button;
  6. pay for the order depending on the selected payment method.

The time of realizations of Orders is determined individually with the Customer.

§8
Delivery and payment methods offered

The Customer may use the following methods of delivery or receipt of the ordered Product:

  1. Courier shipment payable PLN 25 for orders below PLN 1000, above this amount the shipment is free;
  2. Courier shipment payable PLN 10 for orders the plate tiles;
  3. Personal pick-up available at the address of the Decoria Studio warehouse: ul. Wiejska 4, 07-104 Stoczek.

The customer can use the following payment methods:

  1. Payment by bank transfer to the Decoria Studio account;
  2. Electronic payments through the Przelewy24 or Blik platform.

§9
Performance of the Sales Agreement

The conclusion of a Sales Agreement between the Customer and Decoria Studio takes place after the Customer has placed an Order using the Order Form in the Shop according to § 7 of the Regulations.

After placing the Order, Decoria Studio immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation takes place by sending by Decoria Studio to the Customer an appropriate e-mail to the Customer’s e-mail address provided when placing the Order, which contains at least Decoria Studio’s statements about the receipt of the Order and its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. With the moment the receipt of the above e-mail by the Customer, the Sales Agreement is concluded between the Customer and Decoria Studio.

The Customer is obliged to make the payment immediately or within 3 calendar days from the date of the Sale Agreement – otherwise the Order will be canceled.

If the Customer has chosen a delivery method other than pickup in person, the Product will be delivered by Decoria Studio on a date individually agreed with the Customer.

If the Customer chooses to collect the Products in person, the Customer will be informed by Decoria Studio about the readiness of the Products for collection by sending an appropriate e-mail to the Customer’s e-mail address provided during placing the Order. The lead time of order is determined individually with the customer.

Regardless of whether the Customer has chosen the delivery method as courier shipment or personal collection, the Customer will be informed by Decoria Studio about the readiness of the Products to senting or personal pickup by sending an appropriate e-mail to the Customer’s e-mail address provided when he placed the Order. The realization of the Order is always an individual matter.

Delivery of Products is also possible outside the territory of Poland after previously individual agreement of terms and conditions by e-mail.

§10
The right of withdraw from the Agreement

According to Art. 38 point 3 of the Act of 30 May 2014 about consumer rights, the right to withdraw from an Agreement concluded outside the business premises or at a distance is not available to the consumer in relation to contracts where the subject of the service is a non-prefabricated item, manufactured according to the consumer’s specifications or serving to satisfy his personalized needs.

Customer who is a Consumer, by concluding a Sales Agreement with Decoria Studio, is aware that he will not be entitled to withdraw from the Agreement.

§11
Complaint

Decoria Studio is obliged to provide the Client with an item free from defects. The customer realizes, however, that the ordered Products are handcrafted and individual items may slightly differ from each other in terms of color and pattern.

In case of a defect in the goods ordered from Decoria Studio, the Customer has the right to make a complaint based on the provisions of the Civil Code regarding the warranty for defects in the goods sold.

Complaints should be submitted in writing or by e-mail to the Decoria Studio addresses provided in these Regulations. The complaint should include:

  1. name and surname of the advertiser;
  2. e-mail address for correspondence (if it is a different address than the e-mail address from which the complaint was sent);
  3. description of the reason for submitting the complaint;
  4. advertiser’s request.

Decoria Studio will respond to the complaint immediately, and if the Customer is a Consumer – no later than within 14 days. If the Customer is a Consumer and Decoria Studio does not respond to the complaint within 14 days, it is considered that the Customer’s request was considered justified.

Products sent as part of the complaint procedure should be sent to the address of the Shop’s warehouse given in § 3 of these Regulations.

Decoria Studio agrees to out-of-court complaint handling. Detailed information relating the possibility to use out-of-court complaints handling for the Consumer and redress and the rules of access to these procedures are available at the offices and on the websites of district (urban) consumer advocates, social organizations whose statutory tasks include consumer protection, Voivodeship Inspectorates of Trade Inspection and on the website of the Office of Competition and Consumer Protection.

§12
Personal data

The administrator of personal data of Customers who are natural persons, collected through the Shop, is Decoria Studio.

Customer’s personal data collected by the Administrator through the Shop are collected in order to implement the Sales Agreement, and if the Customer agrees – also for marketing purposes.

The recipients of the personal data of the Shop’s customers may be:

  1. In the case of a Customer who uses the method of delivery in the Shop by courier, the Administrator provides the Customer’s collected personal data to the selected carrier or intermediary performing the shipment at the request of the Administrator.
  2. In the case of a Customer who uses the method of electronic payments in the Shop, the Administrator provides the collected personal data of the Customer to the selected entity servicing the above payments in the Shop.

§13
Final resolutions

Agreements concluded through the Shop are concluded in Polish or English.

Decoria Studio reserves the right to make changes Regulations with important reasons, that is: changes in the law, changes in payment and delivery methods – to the extent to which these changes affect the implementation of the provisions of these Regulations. Decoria Studio will inform the customer about each change at least 7 days in advance.

In matters not covered by these Regulations have application generally applicable provisions of Polish law, in particular: the Civil Code, the Act on the provision of electronic services, the Act on consumer rights.
